Terms of service

OVERVIEW

This online store and its associated websites, pages, content, features, products, subscriptions, and services are operated by SAMFCommerce LLC, a Wyoming limited liability company (“SAMFCommerce,” “Company,” “we,” “us,” or “our”).

These Terms of Service (“Terms”) govern access to and use of the Store and purchases made directly from us. By visiting the Store, creating an account, submitting an order, enrolling in a subscription, or otherwise using the Store, you agree to these Terms and to the policies incorporated by reference, including the Return and Refund Policy, Shipping Policy, Subscription and Automatic Renewal Policy, Privacy Policy, and any product-specific terms displayed before purchase.

If you do not agree, do not use the Store or submit an order.

1. Eligibility and Consumer Capacity

You must be at least 18 years old or the age of legal majority in your jurisdiction, whichever is higher, to create an account, submit an order, or enroll in a subscription.

Products intended for use by a child must be purchased and administered by a parent, legal guardian, or other responsible adult in accordance with the label and applicable professional advice. The Store is directed to adults and is not intended for children under 13.

By purchasing on behalf of an organization, you represent that you have authority to bind that organization.

2. Changes to the Terms

We may update these Terms prospectively to reflect legal, security, operational, product, or business changes. The “Effective date” identifies the current version. Material changes will be communicated where required by law.

Changes do not retroactively alter a completed one-time purchase. Changes to an active subscription apply only after any notice or consent required by law.

3. Accounts

You must provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of login credentials and for activity conducted through your account, except where the activity results from our failure to use legally required security measures.

Notify us promptly of suspected unauthorized access. We may suspend or restrict an account where reasonably necessary to protect customers, investigate fraud, comply with law, or prevent harm.

4. Product Information and Availability

We make reasonable efforts to present product descriptions, ingredients, quantities, dimensions, colors, images, packaging, availability, and prices accurately. Displays and photographs may vary because of lighting, screens, packaging revisions, or production batches. Non-material packaging changes do not entitle a customer to a remedy, but a product must still materially conform to its description and mandatory law.

Products and offers may be changed, limited, or discontinued before order acceptance. We may impose reasonable quantity limits and may reject orders that appear intended for unauthorized resale.

5. Health, Wellness, and Dietary Supplement Information

Where the Store offers dietary supplements, foods, wellness products, personal-care products, or products intended for children:

(a) product information is for general educational and commercial purposes and is not medical advice;
(b) no information on the Store creates a clinician-patient relationship;
(c) customers should review the full label, ingredients, allergens, warnings, dosage, age range, and directions before use;
(d) customers should consult a qualified healthcare professional before use if they are pregnant, nursing, taking medication, preparing for surgery, managing a medical condition, purchasing for a child, or uncertain whether a product is appropriate;
(e) products must be used only as directed and kept out of reach of children where the label requires; and
(f) individual experiences and results vary and are not guaranteed.

Where a dietary-supplement structure/function statement requires the statutory disclaimer, the applicable statement is:

“This statement has not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.”

Nothing on the Store should be understood as FDA approval or endorsement unless an official and product-specific authorization expressly supports that statement.

If a serious adverse reaction is suspected, stop use, seek appropriate medical assistance, and contact us at samfcommercellc@gmail.com with product and lot information.

6. Orders and Contract Formation

Submitting an order is an offer to purchase. An automated order confirmation acknowledges receipt but is not necessarily acceptance. Unless applicable law requires otherwise, a contract is formed when we send a shipping confirmation, provide digital delivery, begin the service, or otherwise expressly accept the order.

We may decline or cancel an order before acceptance for reasons including stock unavailability, incorrect pricing, payment failure, suspected fraud, quantity limits, resale concerns, shipping restrictions, sanctions, legal restrictions, product-safety concerns, or errors. If payment was captured, we will refund the canceled amount to the original payment method.

7. Pricing, Currency, and Taxes

Prices are shown in the currency displayed at checkout. Currency conversion, card-issuer fees, and exchange-rate differences may apply and are controlled by third parties.

Prices may change before an order is submitted. Taxes, shipping, duties, and other charges are added where applicable and disclosed at or before checkout to the extent reasonably determinable.

If an obvious pricing or product-information error occurs, we may contact the customer for instructions or cancel and refund the affected order before fulfillment. We will not knowingly enforce an unlawful or deceptive price.

8. Payment

The customer authorizes the payment provider to charge the selected payment method for the total shown at checkout and, for subscriptions, future recurring amounts disclosed before enrollment.

The customer represents that they are authorized to use the payment method and that the billing information is accurate. We may request information reasonably necessary to verify payment or prevent fraud. Payment data may be processed directly by Shopify, payment networks, banks, digital-wallet providers, or other payment service providers.

9. Fraud, Chargebacks, and Abuse

We may cancel, delay, or investigate transactions showing objective indicators of fraud, unauthorized payment, account takeover, reshipping fraud, promotion abuse, false non-delivery claims, or other unlawful conduct.

Customers should contact us promptly about an order problem so that we can attempt to resolve it. Nothing in these Terms removes a lawful right to dispute an unauthorized or incorrect payment. We may provide order, consent, tracking, delivery, communication, and policy records to payment providers when responding to a dispute.

10. Shipping and Delivery

The Shipping Policy is incorporated into these Terms. Delivery dates are estimates unless expressly guaranteed. The customer is responsible for accurate delivery information. Risk of loss passes as described in the Shipping Policy and mandatory law.

11. Returns, Refunds, and Cancellations

The Return and Refund Policy is incorporated into these Terms. No term limits remedies for a defective, unsafe, misdescribed, or nonconforming product where such remedies cannot legally be waived.

12. Subscriptions and Automatic Renewal

The Subscription and Automatic Renewal Policy is incorporated into these Terms. By selecting a subscription, the customer authorizes recurring charges until cancellation. Material terms are disclosed before enrollment. Customers may cancel future renewals using the available online method or by contacting us. A processed renewal order remains subject to the Return and Refund Policy.

13. Promotions, Discounts, Credits, and Gift Cards

Promotions are subject to the terms displayed with the offer. Unless stated otherwise:

(a) promotions have no cash value;
(b) only one promotional code may be used per order;
(c) promotions cannot be combined;
(d) discounts apply only during the stated period;
(e) eligibility may be limited by customer, household, address, device, account, or payment method;
(f) taxes, shipping, duties, subscriptions, gift cards, and certain products may be excluded; and
(g) abuse, duplication, automation, resale, or manipulation may result in cancellation.

Gift cards and store credit are governed by any additional terms displayed when issued and by mandatory unclaimed-property, expiration, and consumer laws.

14. Reviews, Feedback, and User Content

If you submit a review, photograph, video, comment, testimonial, suggestion, or other content (“User Content”), you represent that:

(a) it is based on your genuine experience where presented as a customer experience;
(b) it is accurate to the best of your knowledge;
(c) you own it or have permission to submit it;
(d) it does not infringe privacy, intellectual-property, publicity, or other rights;
(e) it is not unlawful, threatening, defamatory, obscene, fraudulent, or misleading; and
(f) any material connection, incentive, discount, free product, employment, or family relationship is clearly disclosed.

You grant us a non-exclusive, worldwide, royalty-free, transferable and sublicensable license to host, reproduce, adapt, publish, translate, distribute, and display User Content for operating, improving, and marketing the Store and products, subject to applicable privacy and consumer law.

We may moderate or remove content, but we are not required to publish every submission. We will not condition an incentive on a positive review.

15. Intellectual Property

The Store and its original text, graphics, logos, product presentation, photographs, video, software, layout, and other content are owned by or licensed to SAMFCommerce LLC and are protected by applicable intellectual-property laws.

You receive a limited, revocable, non-exclusive, non-transferable right to access the Store for personal, non-commercial shopping. You may not copy, scrape, reproduce, republish, sell, exploit, reverse engineer, frame, mirror, or create derivative works from protected Store content without written permission, except where law expressly permits.

16. Acceptable Use

You may not use the Store to:

(a) violate law or third-party rights;
(b) commit fraud, impersonation, account takeover, payment abuse, or chargeback fraud;
(c) upload malware or interfere with security, availability, or integrity;
(d) scrape, crawl, harvest, or collect data through unauthorized automated means;
(e) bypass quantity, geographic, account, or access restrictions;
(f) submit false, misleading, abusive, or unlawful content;
(g) purchase for unauthorized resale where we have imposed a lawful personal-use restriction; or
(h) assist another person in doing any of the above.

We may restrict access or cancel orders where reasonably necessary to enforce this section.

17. Third-Party Services and Links

The Store may use or link to third-party services, including Shopify, payment providers, carriers, fulfillment providers, subscription platforms, analytics providers, advertising platforms, social networks, and customer-support tools.

Third-party services may be governed by separate terms and privacy notices. We are not responsible for an independent third party’s content or conduct, except to the extent that applicable law makes us responsible for selecting, instructing, or supervising that provider.

18. Privacy and Electronic Communications

The Privacy Policy explains how personal information is handled. By submitting contact information, you agree to receive transactional communications related to orders, accounts, subscriptions, product safety, recalls, and customer service.

Marketing email or text messages are sent only as permitted by law and applicable consent. You may unsubscribe from marketing, but you may continue to receive necessary transactional or legal messages.

19. Suspension and Termination

We may suspend or terminate access to the Store or an account where reasonably necessary because of breach, fraud, security risk, abuse, legal obligation, or risk of harm. Provisions that by their nature should survive termination remain effective, including payment obligations, intellectual property, disclaimers, limitations of liability, and dispute terms.

20. Disclaimer of Warranties

To the maximum extent permitted by law, the Store is provided on an “as available” basis. We do not promise that the Store will be uninterrupted, error-free, or immune from every security threat.

Products are supplied with any express warranty stated before purchase and with every warranty, condition, guarantee, and remedy that applicable law does not permit us to exclude. We do not guarantee a particular personal, cosmetic, wellness, nutritional, medical, financial, or other subjective result.

Nothing in these Terms excludes a warranty or consumer guarantee that cannot legally be excluded.

21. Limitation of Liability

To the maximum extent permitted by law, SAMFCommerce LLC and its members, managers, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for loss of profit, revenue, goodwill, opportunity, or data, arising from the Store or a purchase, where exclusion is lawful.

To the maximum extent permitted by law, aggregate liability arising from a product, order, or service will not exceed the amount the customer paid directly to us for the product, order, or service giving rise to the claim.

These limitations do not apply where liability cannot legally be limited, including liability that applicable law makes non-excludable for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, certain product-liability claims, or breach of mandatory consumer guarantees.

Some jurisdictions do not allow particular exclusions. In those jurisdictions, liability is limited only to the maximum lawful extent.

22. Indemnification

To the extent permitted by law, you agree to indemnify SAMFCommerce LLC against third-party claims, losses, and reasonable costs directly caused by your unlawful use of the Store, willful misconduct, infringement of another person’s rights, fraudulent conduct, or material breach of these Terms. This section does not require a consumer to indemnify us for our own negligence, unlawful conduct, or breach.

23. Events Beyond Reasonable Control

We are not liable for delay or failure caused by events beyond reasonable control, including natural disasters, severe weather, fire, epidemic, war, terrorism, civil disorder, governmental action, sanctions, customs action, carrier disruption, labor dispute, utility failure, cyberattack, or supplier interruption. We will still provide notices, refunds, or other remedies that mandatory law requires.

24. Informal Dispute Resolution

Before filing a claim, the customer and SAMFCommerce LLC agree to make a good-faith effort to resolve the dispute informally, unless urgent relief or applicable law makes that impractical.

Send a written notice to samfcommercellc@gmail.com with the subject line “Legal Dispute Notice.” The notice should include the customer’s name, order number, contact information, a description of the dispute, supporting documents, and the requested resolution. We will attempt to respond within 30 days.

This process does not extend a statutory limitation period unless the law or a written agreement says otherwise, and it does not prevent a customer from using a payment dispute, regulator, small-claims process, or other remedy that cannot legally be restricted.

25. Governing Law and Courts

These Terms and non-contractual disputes are governed by the laws of the State of Wyoming and applicable United States federal law, without regard to conflict-of-law rules, except that a consumer retains the protection of mandatory law that applies in the consumer’s place of residence.

Subject to non-waivable consumer venue rights, the state and federal courts serving Sheridan County, Wyoming have jurisdiction over disputes not resolved informally. Nothing in this section prevents either party from bringing an eligible claim in small-claims court or seeking urgent injunctive relief.

26. Severability, Waiver, and Assignment

If a provision is unlawful or unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain effective.

A failure to enforce a provision is not a waiver. You may not assign your rights or obligations without our written consent. We may assign these Terms in connection with a merger, reorganization, sale of assets, financing, or transfer of the Store, subject to applicable law.

27. Entire Agreement and Order of Priority

These Terms and the incorporated policies form the entire agreement concerning the Store, except for additional terms expressly accepted at checkout or attached to a specific offer.

If terms conflict, the more specific product, promotion, subscription, or checkout term controls for that subject, followed by the Subscription Policy, Return and Refund Policy, Shipping Policy, these Terms, and the Privacy Policy, except where mandatory law requires a different result.
