This Subscription and Automatic Renewal Policy applies whenever a customer selects a recurring-purchase, subscribe-and-save, continuity, replenishment, membership, free-trial conversion, discounted-trial conversion, or other automatic-renewal option offered by SAMFCommerce LLC.
1. Clear Subscription Terms
Before the customer submits a subscription order, the offer will disclose the material terms applicable to that subscription, including:
(a) the product or service included;
(b) the amount charged, or the method for calculating it;
(c) the billing and shipment frequency;
(d) any minimum commitment, if one exists;
(e) the date or event that triggers the next charge;
(f) the duration and end date of any introductory, free, or discounted period;
(g) shipping charges and taxes, where known;
(h) how to cancel, pause, skip, or modify the subscription; and
(i) any other material restriction.
There is no minimum commitment unless a minimum term is clearly and conspicuously disclosed before checkout.
2. Express Authorization
By affirmatively selecting the subscription option and submitting the order, the customer expressly authorizes SAMFCommerce LLC and its payment providers to charge the selected payment method for the initial order and each recurring order at the disclosed frequency until the subscription is canceled.
Subscription consent must be affirmative. A subscription will not be created solely because a customer failed to opt out of a preselected option.
3. Automatic Renewal and Recurring Charges
Subscriptions continue and renew automatically until canceled. The amount of each recurring charge may include the product price, shipping, taxes, and other charges clearly disclosed before the charge.
The timing of a charge may vary slightly because of weekends, holidays, payment processing, inventory, or requested schedule changes. The customer is responsible for maintaining a valid payment method and accurate billing, shipping, email, and telephone information.
4. Managing a Subscription
Where supported by the subscription platform, customers may use their online account or secure subscription-management link to:
(a) cancel;
(b) pause;
(c) skip an upcoming order;
(d) change frequency;
(e) update quantity or product selection;
(f) update the shipping address; or
(g) update payment information.
Changes must be completed before the next renewal order is processed. A requested change is not effective until the system confirms it.
5. Cancellation
Customers may cancel a subscription at any time for future renewals without a cancellation penalty, unless a clearly disclosed and lawful minimum commitment applies.
A customer who enrolled online will be provided an online cancellation method. Cancellation may also be requested by emailing samfcommercellc@gmail.com with the subject line “Cancel Subscription” and the customer’s name, account email, and order or subscription number.
Online cancellation should take effect when confirmed by the system. Email requests will be processed promptly. For certainty, submit cancellation before the next charge is initiated.
If cancellation is received after a renewal order has already been processed, charged, transmitted to fulfillment, or shipped, the cancellation applies to later renewals. The processed order may be returned only if it qualifies under the Return and Refund Policy.
We will not require a customer who enrolled online to make a telephone call, attend an in-person meeting, or complete obstructive retention steps to cancel, where prohibited by applicable law.
6. Cancellation Confirmation
After cancellation, we will provide confirmation electronically. The customer should retain that confirmation. If a charge occurs after the effective cancellation date because of our error, contact us promptly so that we can investigate and provide the remedy required by law.
7. Pauses, Skips, and Modifications
A pause or skipped shipment does not cancel the subscription unless the confirmation expressly says that it is canceled. After the pause or skip period, automatic billing and shipments resume according to the confirmed schedule.
8. Payment Failures and Reattempts
If a recurring charge fails, we may:
(a) notify the customer;
(b) request an updated payment method;
(c) make reasonable payment reattempts through the payment provider;
(d) delay the shipment;
(e) suspend subscription benefits; or
(f) cancel the subscription.
We do not intentionally add a fee solely because our payment attempt failed, but the customer’s bank or payment provider may impose its own charges.
9. Price, Shipping, and Tax Changes
We may change a subscription price, shipping charge, discount, or other material term prospectively. We will provide advance notice and obtain any consent required by applicable law before the change takes effect.
For a material recurring-price increase, we intend to provide at least 30 days’ advance notice unless a different period is required or permitted by applicable law. The notice will explain the new amount, effective date, and cancellation method.
10. Renewal and Reminder Notices
We will provide enrollment confirmations, renewal reminders, annual reminders, trial-ending notices, price-change notices, and other notices where required by applicable law.
For California customers, this may include:
(a) an annual reminder describing the subscription, charge frequency and amount, and cancellation method;
(b) a notice between 15 and 45 days before renewal of an initial term of one year or longer;
(c) a notice between 3 and 21 days before the end of a free or discounted trial longer than 31 days; and
(d) advance notice of an accepted fee change within the legally required period.
Not every subscription requires every type of notice. The notice provided will depend on the subscription and the customer’s jurisdiction.
11. Promotions and Introductory Offers
A promotional or introductory price applies only for the disclosed period. Unless the customer cancels before conversion, the subscription renews at the regular price disclosed before enrollment.
Promotions may be limited to one per customer, household, payment method, device, or address. We may cancel duplicate or abusive promotional enrollments, refunding any amount that applicable law requires us to refund.
12. Product Availability
If a subscription product is unavailable, discontinued, recalled, or restricted, we may delay the shipment, skip the renewal, cancel and refund the affected order, or offer an alternative. We will not substitute a materially different product and charge the customer without any consent required by law.
13. Returns and Refunds
Subscription orders are subject to the Return and Refund Policy. Canceling a subscription does not create a right to a refund for products already delivered, consumed, opened, or processed, except where the Return and Refund Policy or applicable law provides one.
14. Customer Communications
The customer agrees to receive transactional communications necessary to administer the subscription, including enrollment, billing, shipment, failed-payment, product-safety, modification, and cancellation notices. Transactional communications are not marketing messages and may continue when necessary even if the customer opts out of promotional marketing.
15. Mandatory Rights
Nothing in this policy limits a non-waivable right under the Restore Online Shoppers’ Confidence Act, state automatic-renewal laws, payment laws, consumer-protection laws, or the mandatory law of the customer’s jurisdiction.
