This Privacy Policy explains how SAMFCommerce LLC (“SAMFCommerce,” “we,” “us,” or “our”) collects, uses, discloses, retains, and protects personal information when an individual visits, interacts with, or makes a purchase from an online store operated by us, communicates with us, creates an account, joins a subscription, submits a review, or otherwise uses our services (collectively, the “Services”).
For purposes of privacy laws that use the terms “controller,” “business,” or similar concepts, SAMFCommerce LLC is the organization responsible for the personal information described in this policy, except where another organization explains that it acts independently.
1. Personal Information We Collect
Depending on the interaction, we may collect:
(a) Identifiers and contact information, such as name, email address, telephone number, billing address, shipping address, account identifier, username, and customer number.
(b) Order and commercial information, such as products viewed, products purchased, cart activity, subscriptions, returns, refunds, discounts, communication history, preferences, and purchase history.
(c) Payment and transaction information, such as payment method, billing status, transaction identifiers, fraud signals, and limited card details provided by the payment processor. Full payment-card details are generally collected and processed directly by payment providers rather than stored by us.
(d) Account and authentication information, such as login credentials, password hashes, account settings, and security events.
(e) Device and network information, such as IP address, browser, device type, operating system, language, approximate location derived from IP, cookie identifiers, advertising identifiers, referral source, and interaction logs.
(f) Usage information, such as pages viewed, searches, clicks, cart events, checkout events, session activity, marketing interactions, and errors.
(g) Communications, such as emails, support requests, survey responses, product-safety reports, return evidence, photographs, call or chat records where used, and other information voluntarily provided.
(h) Marketing information, such as consent status, subscription preferences, campaign engagement, and inferred product interests.
(i) User Content, such as reviews, photographs, videos, social-media interactions, and testimonials.
(j) Fraud and compliance information, such as address-verification results, risk scores, disputed-payment information, proof of delivery, identity-verification information when reasonably necessary, and records required by law.
(k) Sensitive information. We do not ask customers to provide medical records or detailed health information as part of ordinary shopping. A customer may voluntarily disclose health-related information in a product-safety or support report. We use such information only as reasonably necessary to respond, investigate safety, comply with law, or protect vital interests. Do not send more sensitive information than necessary.
2. Sources of Personal Information
We collect personal information:
(a) directly from the individual, including through checkout, account, subscription, forms, email, reviews, and support;
(b) automatically through the Store, cookies, pixels, software development kits, logs, and similar technologies;
(c) from Shopify and other commerce, hosting, payment, fraud-prevention, subscription, fulfillment, shipping, analytics, advertising, communications, and customer-support providers;
(d) from carriers, warehouses, suppliers, manufacturers, and delivery partners;
(e) from social media or advertising platforms when an individual interacts with our content or authorizes a connection;
(f) from public sources or professional advisers where lawful; and
(g) from another person who purchases a gift or submits information on the individual’s behalf.
3. How We Use Personal Information
We may use personal information to:
(a) provide, operate, maintain, and improve the Services;
(b) create and manage accounts;
(c) process payments, orders, subscriptions, shipments, returns, refunds, and customer requests;
(d) communicate transactional, customer-service, safety, recall, legal, and subscription information;
(e) personalize content, product recommendations, and the shopping experience;
(f) measure performance, troubleshoot, conduct analytics, and develop products or services;
(g) send marketing where consent or another lawful basis permits;
(h) display and moderate reviews and User Content;
(i) prevent fraud, abuse, unauthorized payment, security incidents, and unlawful activity;
(j) verify information and enforce policies;
(k) comply with tax, accounting, product-safety, adverse-event, legal, regulatory, and recordkeeping obligations;
(l) establish, exercise, or defend legal claims;
(m) protect customers, the public, our rights, and our business; and
(n) evaluate or complete a merger, financing, reorganization, sale, acquisition, or other business transaction.
4. Legal Bases for United Kingdom and European Users
Where UK GDPR or similar law applies, we rely on one or more of the following legal bases:
(a) Contract: to take steps requested before a purchase and to perform an order, account, return, or subscription agreement.
(b) Legitimate interests: to secure and improve the Store, prevent fraud, provide customer service, understand business performance, maintain records, and conduct proportionate marketing or personalization where those interests are not overridden by the individual’s rights.
(c) Consent: for non-essential cookies, certain targeted advertising, and marketing where consent is required. Consent may be withdrawn at any time without affecting prior lawful processing.
(d) Legal obligation: to comply with tax, accounting, product-safety, consumer, court, regulatory, and other legal requirements.
(e) Vital interests: in rare situations where processing is reasonably necessary to protect someone’s life or physical safety, such as a serious product-safety event.
5. Cookies and Similar Technologies
We and service providers may use cookies, pixels, tags, local storage, and similar technologies for:
(a) Strictly necessary purposes, such as checkout, fraud prevention, account login, security, cart function, and preference storage.
(b) Functional purposes, such as remembering choices and improving convenience.
(c) Analytics purposes, such as understanding traffic, performance, and interactions.
(d) Advertising purposes, such as measuring campaigns, limiting repetition, building audiences, and showing advertising based on interactions.
Where required, non-essential technologies are used only after appropriate consent. Customers can use the cookie banner, browser controls, and any “Your Privacy Choices” or data-sharing opt-out page made available by the Store. Blocking some technologies may affect functionality.
We honor Global Privacy Control signals for opt-out rights where required by applicable law and supported by the Store’s privacy tools. A general “Do Not Track” signal may not have a uniform legal or technical meaning.
6. How We Disclose Personal Information
We may disclose personal information to:
(a) Shopify and its affiliates, which provide commerce, hosting, checkout, security, analytics, customer-account, and related infrastructure;
(b) payment processors, card networks, banks, digital-wallet providers, fraud-prevention providers, and financial institutions;
(c) suppliers, manufacturers, warehouses, fulfillment providers, carriers, customs brokers, and delivery partners;
(d) subscription, email, text-message, customer-support, review, loyalty, survey, analytics, advertising, and website-optimization providers;
(e) professional advisers, including lawyers, accountants, insurers, auditors, and consultants;
(f) law enforcement, courts, regulators, tax authorities, product-safety authorities, or other parties where we reasonably believe disclosure is required or permitted by law;
(g) parties involved in preventing fraud, abuse, security incidents, or threats to safety; and
(h) a buyer, investor, lender, successor, or adviser in connection with an actual or proposed business transaction.
Service providers are authorized to process information for the services they provide and are subject to contractual or legal obligations where required.
7. Targeted Advertising; Sale or Sharing
We do not sell personal information for money in the ordinary meaning of the word “sell.” However, some privacy laws define “sale,” “sharing,” or “targeted advertising” broadly enough to include disclosures of identifiers, device data, or online activity to advertising and analytics partners.
Where those definitions apply, customers may opt out using the Store’s data-sharing opt-out page, cookie controls, Global Privacy Control, or by emailing samfcommercellc@gmail.com with the subject line “Privacy Opt-Out.”
We do not knowingly sell or share for targeted advertising the personal information of individuals under 16.
8. Marketing
Marketing email and text messages are sent only as permitted by applicable law. A recipient may unsubscribe using the link or instructions in the message. An opt-out from marketing does not stop transactional messages necessary for orders, subscriptions, account security, product safety, recalls, or legal notices.
If SMS marketing is offered, the specific consent language, message frequency, carrier charges, HELP and STOP instructions, and other material terms will be disclosed at the point of opt-in.
9. Data Retention
We retain personal information only for as long as reasonably necessary for the purposes described in this policy, including to:
(a) complete orders and subscriptions;
(b) provide customer service;
(c) maintain tax, accounting, payment, fraud, product-safety, adverse-event, and legal records;
(d) resolve disputes and enforce agreements; and
(e) comply with mandatory retention periods.
Retention varies by category and jurisdiction. When information is no longer reasonably needed, we delete, de-identify, or securely dispose of it, subject to lawful backups and legal holds.
10. Security
We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. No system, transmission, or storage method is completely secure. Customers should use unique passwords, protect account credentials, and notify us of suspected unauthorized access.
11. International Transfers
SAMFCommerce LLC is based in the United States, and Shopify and other providers may process information in the United States, Canada, the United Kingdom, the European Economic Area, Australia, or other countries where they or their subprocessors operate.
Those countries may have privacy laws different from the individual’s country. Where required, we use recognized transfer mechanisms, contractual protections, adequacy decisions, or other lawful safeguards.
12. Privacy Rights
Depending on jurisdiction and subject to legal exceptions, an individual may have the right to:
(a) know whether we process personal information;
(b) access or obtain a copy;
(c) correct inaccurate information;
(d) delete information;
(e) receive portable information;
(f) restrict or object to processing;
(g) withdraw consent;
(h) opt out of sale, sharing, targeted advertising, or certain profiling;
(i) limit certain uses of sensitive personal information;
(j) appeal a denied request; and
(k) receive equal service without unlawful discrimination for exercising a privacy right.
To submit a request, email samfcommercellc@gmail.com with the subject line “Privacy Request” and describe the request. We may verify identity by matching information associated with the account or order. We will request only information reasonably necessary for verification.
An authorized agent may submit a request where law permits. We may require proof of authorization and may verify the customer directly.
We may deny or limit a request where an exception applies, including where information is needed to complete a transaction, detect fraud, maintain security, comply with law, protect rights, or establish or defend claims. Where an appeal right applies, reply with the subject line “Privacy Appeal.”
13. United States State Privacy Notice
For residents of states with comprehensive privacy laws, the categories collected during the preceding 12 months may include:
(a) identifiers and customer-record information;
(b) commercial and transaction information;
(c) internet or electronic-network activity;
(d) approximate geolocation;
(e) audio, visual, and electronic communications where submitted;
(f) inferences regarding preferences;
(g) account-login and payment-related information treated as sensitive under certain laws; and
(h) health-related information voluntarily submitted in a product-safety communication.
We collect and disclose these categories for the business and commercial purposes described in Sections 3 and 6. We retain them as described in Section 9.
We do not use sensitive personal information to infer characteristics about a person for unrelated purposes. We do not knowingly sell or share personal information of individuals under 16 for targeted advertising.
14. California Notice at Collection
California residents should review Sections 1, 3, 6, 7, 9, 12, and 13 for the categories collected, purposes, disclosures, retention criteria, and rights.
Where our advertising disclosures constitute “sale” or “sharing” under California law, a California resident may opt out through the Store’s “Your Privacy Choices” or data-sharing opt-out page, through a recognized Global Privacy Control signal, or by contacting us.
We will not unlawfully discriminate against a California resident for exercising a CCPA/CPRA right. If we later offer a program that constitutes a financial incentive under California law, we will provide the legally required notice before enrollment.
15. United Kingdom and European Rights
Where UK GDPR or EU GDPR applies, an individual may complain to the data-protection authority in their country. UK residents may complain to the Information Commissioner’s Office after first giving us an opportunity to address the concern.
The Store’s availability in a country does not itself state that SAMFCommerce LLC has appointed a local representative. Where appointment of a representative is legally required, the applicable details will be added to this policy before or when required.
16. Canada
Canadian individuals may request access or correction, withdraw consent subject to legal or contractual restrictions, and raise a privacy concern with us. Consent must be meaningful in light of the nature, purpose, and consequences of the processing. If a concern is not resolved, an individual may contact the appropriate federal or provincial privacy authority.
17. Australia and New Zealand
Individuals may request access or correction and submit a privacy complaint to us. We will investigate and respond within a reasonable period. Where applicable privacy law provides a right to complain to a regulator, that right remains available.
18. Children’s Privacy
The Store is intended for adults and does not knowingly collect personal information directly from children under 13. A product intended for a child must be purchased by an adult.
If we learn that personal information was collected directly from a child in violation of applicable law, we will take reasonable steps to delete it. A parent or guardian may contact samfcommercellc@gmail.com.
We do not knowingly sell or share for targeted advertising the personal information of individuals under 16.
19. Third-Party Sites
The Services may link to independent websites or platforms. Their privacy practices are governed by their own notices. Review those notices before providing personal information.
20. Changes to This Policy
We may update this Privacy Policy to reflect changes in law, technology, providers, products, or data practices. The effective date will be revised. We will provide additional notice or obtain consent where required for a material change.
